Rental Agreement

2. Vehicle Information

The vehicle is delivered in working condition unless otherwise documented.

3. Eligibility & Required Documents

The Renter and any additional driver must:

• Be at least 18 years old
• Hold a valid driver’s license
• Present a valid passport at handoff

Failure to provide required documents will result in cancellation. No exceptions.

4. Authorized Drivers

• Only the Renter and any drivers listed below are authorized to operate the vehicle
• Each additional driver must sign this Agreement
• The Renter remains fully responsible for all authorized drivers

Unauthorized drivers constitute a breach of this Agreement and result in full liability.

5. Security Deposit

• A security deposit is required at handoff
• The deposit will be charged using the same card used for the reservation
• The Renter authorizes this charge

The deposit may be applied toward:

• Damage to the vehicle
• Theft or loss
• Missing accessories (helmet, keys, holder, etc.)
• Late return
• Excessive cleaning
• Any breach of this Agreement

The deposit does not limit the Renter’s liability. The Renter is responsible for all costs exceeding the deposit.

6. GPS Tracking

Vehicles may be equipped with GPS tracking devices.

By signing this Agreement, the Renter:

• Consents to real-time tracking of the vehicle
• Acknowledges tracking may be used for recovery, security, and operational purposes

Tampering with or disabling GPS equipment is strictly prohibited and constitutes a breach of this Agreement.

7. Rental Period & Late Return

The vehicle must be returned at the agreed time.

• Grace period: up to 30 minutes (at Company discretion)

After that:

• Up to 2 hours late: additional charges may apply
• More than 2 hours late: full additional rental day charged

Failure to return the vehicle may result in:

• Recovery actions
• Additional charges
• Legal action

8. Use of Vehicle

The Renter agrees to:

• Operate the vehicle safely and responsibly
• Follow all applicable traffic laws
• Use the vehicle only for lawful, personal purposes

9. Prohibited Use

The following are strictly prohibited:

• Driving under the influence of alcohol or drugs
• Reckless or negligent driving
• Allowing unauthorized drivers
• Off-road or unsafe terrain use
• Illegal activity

Violation may result in immediate termination of the rental and full liability.

10. Responsibility & Liability

The Renter assumes full responsibility for the vehicle during the rental period.

The Renter is liable for:

• All damages to the vehicle
• Theft or loss
• Third-party damages or injuries resulting from use

11. Total Loss or Theft

If the vehicle is stolen, destroyed, or deemed a total loss, the Renter is responsible for:

• Full replacement value of the vehicle
• Loss of use
• Administrative and recovery costs

12. Accidents & Incidents

In case of accident or issue, the Renter must:

• Notify the Company immediately
• Follow instructions
• Cooperate with authorities

Failure to report may result in full liability.

13. Traffic Fines & Confiscation

The Renter is responsible for:

• Traffic violations
• Parking fines
• Towing fees
• Impound fees
• Legal costs

If the vehicle is confiscated, rental charges continue until recovery.

14. Vehicle Condition & Damage

The Renter agrees that:

• The vehicle is received in acceptable condition
• Any pre-existing damage is documented

The Renter is responsible for:

• Cosmetic damage (scratches, dents)
• Structural damage
• Mechanical damage
• Missing parts

All damages are charged at market repair or replacement cost.

15. Insurance

Any insurance provided is limited and may not cover all damages.

It does not apply in cases of:

• Negligence
• Prohibited use

The Renter remains financially responsible.

16. Assumption of Risk

The Renter acknowledges that operating a scooter involves inherent risks, including serious injury or death.

By signing this Agreement, the Renter voluntarily assumes all such risks.

17. Release of Liability

To the maximum extent permitted by law, the Renter releases Scooters Punta Cana IAPC from any liability for:

• Accidents
• Injuries
• Death
• Third-party actions
• Road or weather conditions

18. Indemnification

The Renter agrees to indemnify and hold harmless the Company from any claims, damages, or legal actions arising from use of the vehicle.

19. Joint Liability

All authorized drivers are jointly and severally liable for all obligations under this Agreement.

20. Return Conditions

The vehicle must be returned:

• On time
• In the same condition
• With all accessories

Failure to comply will result in additional charges.

21. Breach of Agreement

Any violation of this Agreement may result in:

• Immediate termination of rental
• Loss of deposit
• Full financial liability

22. Governing Law

This Agreement is governed by the laws of the Dominican Republic.

Jurisdiction: La Altagracia (Bávaro / Punta Cana)
